NPDES Permit Term Reform
Water infrastructure projects have grown more complex and costly due to increasingly technical water quality treatment requirements, and these projects now often take longer to complete than the five-year term of a National Pollutant Discharge Elimination System (NPDES) permit. This mismatch between permit timelines and real-world construction schedules creates a regulatory gap that needed to be addressed. ENS Resources worked with a state association to lead a national policy effort to extend the NPDES permit term from 5 to 10 years to better align federal regulations with the actual pace of water infrastructure projects. This effort resulted in its House passage, which is now part of broader congressional negotiations on comprehensive permit term reform.
