ENS Resources, on behalf of our client, led a coalition of water agencies, environmental organizations, and state Attorneys General to defend one of the most consequential environmental legal victories of its time: South Tahoe Public Utility District's landmark case proving MTBE-blended gasoline was a defective product. When oil companies lobbied Congress for an MTBE liability waiver in the Energy Policy Act of 2005, threatening to shift $29 billion in cleanup costs onto taxpayers, the coalition defeated the effort, keeping responsibility with the oil companies.

ENS Resources advocates for the Tahoe Water for Fire Suppression Partnership, a bi-state coalition of Lake Tahoe Basin water agencies, to address a $120 million gap in wildfire-ready water infrastructure. This regional coalition, the outgrowth of representing a single client, has secured over $36 million in appropriations and authorization of the project under both the Lake Tahoe Restoration Act and the Water Resources Development Act of 2020.


To build on these successes, ENS Resources created an ad hoc coalition of national organizations representing special districts, emergency service providers, and agricultural water users. This coalition secured bipartisan introduction of S. 4812, the FIRE SMART Act, and won inclusion of a provision making water infrastructure for fire suppression eligible under the Drinking Water State Revolving Fund in S. 4949, the Water Resources Development Act of 2026. This unique focus on targeted coalitions, has cemented federal recognition that resilient water infrastructure is essential to a cohesive wildfire mitigation strategy to protect at-risk communities.
It involves collaborating with the client on the complex requirements related to federal assistance: applications, alignment, tracking milestones, and advising on necessary steps to advance successful assistance obligation.
